Eviction – Have you got a good lease?
Think your tenant(s) will leave when you ask them? For a Landlord, purchasing a property to let would tend to indicate a safe investment. However, the granting of atenancy agreement can turn this into a rather risky business. Yet more and more Landlords find themselves in the position of their tenants being in rental arrears; confused and uncertain about their rights and unable to resolve the situation. Unfortunately, due to confusing and complex Scottish legislation together with prolonged court procedures, Landlords who are not getting paid rent will continue to haemorrhage money for a long time to come.
Some Landlords in this position attempt to navigate the eviction themselves. Surely as the tenant is no longer fulfilling their obligations, they have no right to stay in your property? Wrong! Evicting any tenant illegally can lead to Landlords being arrested! Landlords must know that getting any tenant evicted will take time. However, if it is done wrong it will take much longer. The longer it takes the longer the rental haemorrhage continues.
The court will not empathise with any Landlords financial concerns if they have not clearly followed the complex procedures. Rental Arrears? Do you want to arrest their earnings/bank account without going to court? Do you have a registered lease? Using specialist procedures you can turn the law in your favour.
