We consider every disagreement to be a potential opportunity for constructive resolutions.

It is imperative to ensure that the legal team you choose for a dispute possesses the necessary skills and attributes that align with your particular requirements. Our Conflict Resolution Group is comprised of a variety of specialists, which guarantees that we can provide the ideal complement for you regardless of your position.

Though alternative dispute resolution (ADR) can manifest in various ways, the following are the most prevalent:

Commercial negotiation

This is often disregarded as a form of ADR; however, the majority of disputes can be resolved simply by reaching an agreement if the negotiation is conducted effectively and both parties are provided with sound advice. With over a century of collective experience representing clients in dispute negotiations, our team is well-versed in effective strategies.

Mediation – Solicitor Glasgow

In this form of consensual dispute resolution, an impartial mediator assists the parties in settling. Conditions remain non-binding until a final agreement is reached. Instead of determining a victor or victim, mediation provides an opportunity for creative resolutions that serve the interests of all parties. The role of the Mediator is to aid in the inquiry process.

The entirety of the procedure is conducted in strict confidence; in fact, the involved parties may mutually consent to any subsequent court action not requiring a reference to the mediation. The process can be extremely efficient and economical; in fact, the majority of mediations conclude with an agreement reached in a single day (typically after a few weeks of preparation time beforehand), allowing the involved parties to resume their daily activities.

Our team comprises accredited mediators who are readily available to serve as mediators in any dispute you may have or can expertly represent you throughout the process. With our extensive knowledge and experience, we can assist you in determining whether a dispute is amenable to mediation and then walk you through the mediation procedure.

We strictly adhere to a Code of Conduct and maintain a strict policy of confidentiality when serving as mediators.

Arbitration

In this mode of dispute resolution, a third party with specialised knowledge is retained to render a decision. The powers and responsibilities of the arbitrator are constrained by the clauses in the agreement between the parties that govern his appointment as arbitrator.

One advantage of arbitration is that the arbitrator possesses expertise in the specific subject matter of the dispute. The procedure is kept private. When requested, the arbitrator will render a decision regarding the points of contention, which may be in favour of or against either party. Except in exceptional circumstances, the parties will be legally obligated to abide by the arbitrator’s decision. Consider private sector disputes.

Adjudication

A subset of arbitration is adjudication. In the construction industry, this procedure is protected by law through the provision of a right to access it, no matter the parties’ agreement. While the parties are obligated to respect the decision of an expert third-party arbitrator who resolves a dispute, that decision is not legally binding. However, if the decision is correct, the parties may choose to revisit the dispute through litigation or arbitration, potentially with a different outcome.

Adjudication serves to facilitate the prompt resolution of disputes, thereby ensuring the preservation of cash flow and, where applicable, enabling the parties to proceed with the execution of their contractual agreement. The regulations stipulate that the dispute must be resolved within twenty-eight days on average, so the procedure is extremely swift.

As a result, prompt, proficient, and responsive legal representation is necessary. Our team is exceptionally adept at quickly mobilising the formidable professional support that you require.
