The breakdown of a marriage is a trying time for all those involved. At Complete Clarity Solicitors, we understand the different challenges that fathers and mothers face. We meet many dads going through a divorce who are concerned about the potential impact on their relationship with their children, as well as what the financial outcome could be.

Our Divorce Lawyers provide a service that is adapted to your particular situation. We will get to know you, the circumstances involved and your priorities so we can offer advice and support that meets your individual needs.

Our team have helped many fathers to reach a fair and successful divorce settlement. If your marriage has broken down and you are looking for a legal team that will understand and protect what matters most to you, we can help. Contact us today.

Childcare and contact

When you are going through a divorce and have children under the age of 16, numerous decisions must be made for your child, including:

  • where they will live;
  • how much contact they will have with each parent; and
  • how they will be financially supported.

For children over 16, you may need to agree on the financial arrangements for their support, as a duty to provide for your child exists until they are 18 (if they are full-time at school or college) or 25 (if they are in full-time further education).

Alternative Dispute Resolution

It will be most beneficial to all those involved if you and your former spouse can reach an agreement on these matters. We understand this is often easier said than done, especially if the divorce is non-amicable. However, there are several methods you can use to help you agree – known collectively as Alternative Dispute Resolution (ADR). These include negotiation, mediation, collaboration and arbitration. ADR offers many advantages over court proceedings. Importantly, they give you greater control over the outcome. They also tend to be:

  • quicker;
  • less damaging to relationships;
  • less stressful; and
  • more economical.

Our lawyers will advise and represent you throughout this process. We aim to help you reach a solution that, most importantly, is in the best interest of your children, but which is also fair to you and your former spouse.

Court order

If negotiations are unsuccessful, you will need to ask a court to make decisions relating to childcare and contact for you. Fathers often feel they get a raw deal regarding access to their children in divorce proceedings. That is why, if your divorce ends up in court, our team will passionately protect your parental rights and fight hard to get you the most successful outcome. It is important to know that the court will only issue an order that is in the best interests of your child.

Financial settlement

Our clients who are fathers also tend to have concerns about the impact divorce will have on their financial situation. Again, if you can reach an out-of-court agreement on how your property and finances are to be dealt with, this will give you more say and control over the outcome, as well as many other benefits.

Our Divorce Solicitors will take care to understand the full extent of your financial situation, concerns and priorities, and provide clear advice on the best negotiation strategy. We will use our extensive family law experience and first-rate negotiation skills to get you a successful financial settlement, which protects you now and in the long term.

If you and your former spouse cannot agree, however, we will provide robust representation of your interests in court.
