If you fail to keep up with repayments on your mortgage or other loan which is secured on your home, your lender may take steps to repossess your home.

Your lender CANNOT, however, simply throw you out of the property – they must comply with the law on the matter which involves taking certain steps before you are removed, including acquiring a court order stating that you must leave the property.

If you fall behind on your mortgage, you may be served one or more notices by your lender:

These, are a ‘notice of default’ which asks you to make good the arrears, or a calling up notice, which brings the mortgage agreement to an end and asks you to pay the balance in full.

Before repossessing, your lender must take reasonable steps to inform you of the terms of your agreement and to contact you to discuss the arrears. Whether this has happened or not, it’s important to take advice as soon as you can.
